PHANTOM MFG TERMS OF SALE AND USE

These Terms of Sale and Use (“Terms”) govern your access to and use of the PHANTOM MFG website and your purchase or use of products sold by PHANTOM MFG, doing business as PHANTOM MFG (“PHANTOM MFG,” “we,” “us,” or “our”).

By accessing the website, placing an order, installing, or using a PHANTOM MFG product, you agree to these Terms. If you do not agree, do not purchase, install, or use our products.

1. Eligibility

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to place an order.

2. Aftermarket Parts and Fitment

PHANTOM MFG sells aftermarket e-bike components and accessories. Product descriptions may identify intended compatibility, but you are responsible for confirming compatibility with your specific bike model, year, configuration, and any previously installed parts before ordering or installation.

Unless we expressly state otherwise in writing, PHANTOM MFG products are not manufactured, endorsed, or approved by Sur-Ron, Talaria, or any other original-equipment manufacturer. Brand names may be used only to describe intended fitment.

3. Installation, Inspection, and Safe Use

You are responsible for proper installation, inspection, maintenance, and use of every product.

We strongly recommend installation by a qualified technician familiar with e-bike and motorcycle-style components. Follow all provided instructions, torque specifications, warnings, and applicable laws. Do not use a product that is damaged, improperly installed, altered, loose, worn, or otherwise unsafe.

Before every ride, inspect your bike and its components. Stop riding immediately if you notice damage, unusual movement, a loose fastener, abnormal noise, or any other safety concern.

4. Assumption of Risk

Riding electric bicycles and using aftermarket components involve inherent risks, including serious injury, death, property damage, crashes, component failure, loss of control, and risks caused by weather, terrain, traffic, installation errors, maintenance issues, or misuse.

To the maximum extent permitted by law, you knowingly and voluntarily assume the ordinary risks associated with the installation, maintenance, and use of PHANTOM MFG products. Nothing in these Terms releases or limits liability that cannot legally be released or limited.

5. Prohibited Use

You may not use PHANTOM MFG products:

  • Contrary to product instructions, warnings, or applicable laws;

  • On a bike or configuration for which the product is not intended;

  • After modifying, damaging, or improperly installing the product;

  • In a manner that creates an unreasonable risk to yourself or others; or

  • For commercial resale without our written permission.

You are responsible for complying with all local, state, federal, and international laws relating to e-bike operation, modifications, helmet use, road use, and off-road riding.

6. Orders, Pricing, and Availability

All orders are subject to acceptance and product availability. We may correct pricing, product-description, inventory, or typographical errors at any time, including after an order is placed. If a correction materially affects your order, we will contact you or issue a refund where appropriate.

Prices are shown in [USD] unless stated otherwise and do not include taxes, shipping, duties, or other charges unless expressly stated.

7. Shipping and Delivery

Shipping dates are estimates unless we specifically guarantee a delivery date in writing. We will provide notice and available options if an order is materially delayed.

You are responsible for providing a complete and accurate shipping address. Risk of loss transfers only as permitted by applicable law. If a package is lost, damaged, or misdelivered, contact us at [SUPPORT EMAIL] promptly so we can assist.

8. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by our current return system VIA EMAIL, which is incorporated into these Terms.

Products that have been installed, used, damaged, altered, or returned without original packaging may be ineligible for return, subject to applicable law.

9. Warranty

Any written PHANTOM MFG limited warranty is available at [Warranty Policy URL] and is incorporated into these Terms. The written warranty states its duration, coverage, exclusions, and claim process.

Except as provided in a written warranty and to the maximum extent permitted by law, PHANTOM MFG disclaims all other warranties, whether express, implied, or statutory. Some jurisdictions do not permit certain warranty exclusions or limitations, so some of these limitations may not apply to you.

Nothing in these Terms limits rights that applicable law does not allow us to limit.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHANTOM MFG, ITS OWNERS, EMPLOYEES, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST USE, LOSS OF DATA, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO OUR WEBSITE OR PRODUCTS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

These limitations do not apply where prohibited by law, including for fraud, willful misconduct, gross negligence, or liability that cannot legally be excluded.

11. Indemnification

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless PHANTOM MFG and its owners, employees, suppliers, and affiliates from claims, losses, damages, liabilities, and expenses arising from your unlawful use, improper installation, alteration, misuse, negligent maintenance, or resale of a PHANTOM MFG product.

This section does not require you to indemnify PHANTOM MFG for claims caused by our own negligence, willful misconduct, or a defect for which we are legally responsible.

12. Intellectual Property

The PHANTOM MFG name, logo, product photography, designs, text, graphics, and website content are owned by or licensed to PHANTOM MFG and may not be copied, reproduced, modified, or used without our prior written permission.

13. Third-Party Services

Our website may use Shopify and other third-party services for payment processing, shipping, analytics, or communications. Your use of those services may also be subject to their separate terms and privacy policies.

14. Privacy

15. Governing Law and Venue

Phantom MFG — Return Policy

Overview

We want you to be satisfied with your Phantom MFG purchase. Eligible items may be returned within 30 days of delivery, subject to the conditions below.

Return requests must be submitted within 30 days of the delivery date. Once a return is approved, the item must be shipped back within 10 days of receiving return authorization.

How to Start a Return

Email returns@phantommfg.co with:

  • Your order number

  • The item(s) you would like to return

  • The reason for the return

  • Photos of the item, if applicable

Do not ship a return until you receive approval and return instructions from Phantom MFG.

Returns sent without prior authorization may be refused, delayed, or returned to the sender.

Restocking Fees

Approved returns are subject to the following restocking fees, calculated from the purchase price of the returned item:

  • 15% restocking fee — unopened, unused items returned in original, resalable condition with all original packaging, hardware, accessories, and materials.

  • 20% restocking fee — items that have been opened or removed from their original packaging but remain unused, uninstalled, complete, and in resalable condition.

  • Up to 35% restocking fee — items showing signs of installation, handling, use, cosmetic damage, missing packaging or hardware, alteration, modification, tampering, or other conditions that reduce the item's resale value.

Items that are excessively damaged, broken, incomplete, modified, tampered with, improperly installed, or otherwise unsuitable for resale may be refused for return entirely.

Restocking fees do not include original shipping charges or return shipping costs.

Non-Returnable Items

The following items are not eligible for return unless determined to have a manufacturing defect or unless Phantom MFG shipped the incorrect item:

  • Items marked as final sale or refurbished

  • Custom, made-to-order, engraved, or personalized products

  • Electrical components that have been installed, connected, programmed, modified, or energized

  • Items damaged through crashes, accidents, abuse, misuse, improper installation, or incompatible components

  • Items that have been permanently modified or altered by the customer

Return Shipping

Customers are responsible for all return shipping costs unless the return is the result of:

  • An incorrect item shipped by Phantom MFG

  • A verified manufacturing defect

  • Another fulfillment error caused by Phantom MFG

We strongly recommend using a trackable and insured shipping method.

Phantom MFG is not responsible for returned packages that are lost, stolen, or damaged while in transit to us.

Customers are responsible for securely packaging returned products to prevent shipping damage.

Refunds

Once your return is received, Phantom MFG will inspect the item and notify you whether the return has been approved.

Approved refunds will be issued to the original payment method, minus any applicable:

  • Restocking fees

  • Original shipping charges

  • Other non-refundable costs stated in this policy

Original shipping charges are non-refundable unless the return resulted from an error by Phantom MFG.

Approved refunds are generally issued within 5–10 business days after inspection. Your bank or payment provider may require additional time for the refund to appear in your account.

Damaged, Defective, or Incorrect Items

If your order arrives damaged, defective, or incorrect, contact returns@phantommfg.co within 7 days of delivery.

Please include:

  • Your order number

  • A description of the issue

  • Clear photos or videos showing the problem

  • Photos of the packaging if the item was damaged during shipping

After reviewing and verifying the issue, Phantom MFG may provide a replacement, repair, replacement component, or refund, as appropriate.

Verified manufacturing defects and Phantom MFG fulfillment errors are not subject to restocking fees.

Damage caused by improper installation, misuse, crashes, accidents, modifications, incompatible components, normal wear, or failure to follow installation instructions is not considered a manufacturing defect.

Condition of Returned Products

Customers are responsible for returning products in the same condition represented when requesting return authorization.

If an item's condition when received differs materially from the condition described or photographed during the return request, Phantom MFG may adjust the applicable restocking fee or refuse the return.
